1. ACCEPTANCE OF TERMS & SCOPE OF SERVICES

Welcome to Nina Global Holistics, LLC. By accessing our website, booking a session, enrolling in a mentorship, or participating in any training, you (“Client,” “Student,” “User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use our website or services.

Scope of Practice & Practitioner Role

• Co-Creative Partnership & Guide Role: Services including Reiki, intuitive sessions, energy healing, spiritual coaching, workshops, and mentorships are facilitated by Yanitza Nina. The practitioner acts as an intuitive guide and teacher. Mentorship is a two-way partnership: the work works only when the Client actively applies the guidance and engages in consistent self-practice.
• No Guarantee of Outcomes: Transformation varies by individual. A practitioner is strictly not responsible for client outcomes, personal decisions, physical/emotional responses, or specific life results. Deep healing creates internal and external shifts; as your personal frequency adjusts, life circumstances may evolve—this is a normal part of the process.
• Non-Medical Disclaimer: All offerings are non-medical, non-clinical, and spiritual/holistic in nature. Yanitza Nina and Nina Global Holistics, LLC do not provide medical, psychiatric, or psychological diagnosis, treatment, or prescriptions. Clients must consult licensed healthcare professionals for physical or mental health concerns.
• Substance, Sobriety & Safety Policy: To maintain the safety, energetic clarity, and integrity of all healing containers, Client agrees to attend all virtual and in-person sessions, workshops, and trainings completely sober and free from the influence of alcohol, recreational drugs, or non-prescribed mind-altering substances. Practitioner reserves the absolute right to immediately terminate or cancel any session or training—without refund, credit, or rescheduling—if Client appears impaired, under the influence, or unable to participate safely and coherently.

2. INFORMATION COLLECTION, COOKIES & PRIVACY

• Data Collection: We collect personal information (name, email address, phone number) when you submit lead forms, book sessions, or purchase services.
• Cookies & Tracking: We use cookies, Google Analytics, Facebook Pixels, and similar technologies to analyze site traffic, tailor user experiences, and run marketing communications. By using our website, you consent to our data and cookie practices.
• Data Security: We implement reasonable security measures to protect your personal details processed via secure third-party platforms (e.g., Acuity Scheduling, Stripe). However, no internet transmission is 100% secure, and users submit information at their own risk.

3. REFUND, SCHEDULING, CONTAINER & EXPIRATION POLICIES

Strict No-Refund Policy

All payments, package fees, deposits, mentorship investments, and certification tuition are 100% non-refundable and non-transferable. Payment reserves Practitioner’s time, energetic container, and proprietary teachings.

Pacing, Expiration & Automatic Forfeiture

To maintain momentum and energetic integrity:

• 4-Session Containers: Must be completed within four (4) consecutive weeks from the date of purchase or first session.
• 8-Session Containers: Strongly recommended to conduct the first four (4) sessions weekly, and the remaining four (4) sessions weekly or bi-weekly. All eight sessions must be completed within three (3) months.
• Extended Mentorships: Must adhere strictly to the schedule established during onboarding.
• Automatic Forfeiture: Unused sessions past their expiration date are automatically forfeited, and the container will conclude without refund, rollover, or credit.

Client Scheduling Accountability & Punctuality

• Reminders are automatically sent, however, the practitioner is not responsible for missed or forgotten sessions. Clients are responsible for booking and rescheduling their appointments via the designated scheduling portal based on real-time availability.
• Clients must arrive on time. Late arrivals past 10 minutes will not receive time extensions. No Shows will NOT be rescheduled. 
• Excessive Rescheduling: Frequent rescheduling disrupts the energetic container and may lead to termination of services without refund.

4. SESSION RECORDINGS & AI TOOL USAGE

• Zoom Platform: All virtual sessions are conducted and recorded via Zoom unless mutually agreed upon in writing via email at least 24 hours in advance.
• AI Note-Taking & Transcriptions: Practitioner utilizes artificial intelligence tools to record, transcribe, and summarize meeting notes, voice messages, homework, and aftercare instructions. All AI-generated outputs are reviewed, curated, and approved by Yanitza Nina first to ensure alignment with channeled insights and teachings.

5. REIKI & ENERGY HEALING CERTIFICATIONS & MENTORSHIP DISCLAIMERS

• Educational & Attunement Purpose Only: Certification programs (e.g., Reiki Level I, II, Master/Teacher) cover designated curriculum and attunements.
• No Employment Guarantee: Certification through Nina Global Holistics, LLC does not constitute an offer of employment, job placement, client referral guarantee, or formal business partnership with Yanitza Nina or the Company.
• Independent Practice & Support: Students operate independently. Post-certification support is provided strictly at Practitioner’s discretion and real-time availability and is not guaranteed as an ongoing entitlement.

6. INTELLECTUAL PROPERTY & PERMITTED USE

• Single-User License: All course materials, workbooks, recordings, live sessions, and digital content provided by Nina Global Holistics, LLC are for individual, non-commercial use only.
• Restrictions: Anti-Theft Restrictions: Client/Student is strictly prohibited from copying, reproducing, sharing, distributing, selling, teaching, licensing, or creating derivative works based upon any proprietary frameworks or channeled curriculum without the express, prior written authorization of Yanitza Nina. Any unauthorized use, IP theft, or commercial exploitation of these materials will result in immediate termination of access without refund and may subject the offender to legal prosecution and damages under federal and state intellectual property laws.

7. PROFESSIONAL CONDUCT, ALIGNMENT & REVOCATION

• Container Integrity: High standards of mutual respect and commitment are required.
• Right to Terminate: Nina Global Holistics, LLC reserves the right, in its sole discretion, to suspend or terminate services or community access immediately, without refund, if a Client or Student demonstrates disrespect, hostile or manipulative behavior, constant conflict, or energetic misalignment that disrupts the safety and cohesion of the container.

8. RELEASE OF LIABILITY, INDEMNIFICATION & NON-DEFAMATION

• Assumption of Risk: Client/Student voluntarily assumes all physical, emotional, energetic, and mental risks associated with participating in sessions, breathwork, meditations, or workshops (virtual or in-person).
• Comprehensive Waiver & Indemnification: You agree to defend, indemnify, and hold harmless Yanitza Nina, Nina Global Holistics, LLC, and its officers, contractors, and affiliates from any claims, damages, liabilities, losses, small claims actions, or lawsuits arising out of your participation in our programs or breach of these Terms.
• Anti-Defamation Agreement: You agree not to engage in any form of slander, libel, public disparagement, or negative posting regarding Yanitza Nina, Nina Global Holistics, LLC, or its representatives on social media or public platforms.

9. GOVERNING LAW & JURISDICTION

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. Any legal action or dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Florida, USA.
